What an employer can pay into a company pension (betriebliche Altersversorgung) without wage tax or social security contributions: 8 percent of the contribution ceiling tax-free (§ 3 Nr. 63 EStG), 4 percent free of contributions (§ 1 SvEV), plus flat-rate taxation under § 40b EStG. Also the subsidy for low earners under § 100 EStG, including the values promulgated for 2027, and the mandatory 15 percent top-up on salary conversion.

Rules from statutes and administrative guidance
- Employer contributions from the first employment to a pension fund, a Pensionskasse or a direct insurance are tax-free up to 8 percent of the pension insurance contribution ceiling per calendar year (§ 3 Nr. 63 Satz 1 EStG).
- When employment ends, an additional 4 percent of the contribution ceiling per year of service is tax-free, for at most ten calendar years (§ 3 Nr. 63 Satz 3 EStG).
- For calendar years in which employment was suspended and no taxable wages were paid, contributions of up to 8 percent of the contribution ceiling per year may be paid later tax-free, for at most ten years (§ 3 Nr. 63 Satz 4 EStG).
- The tax-free maximum is reduced by contributions taxed at a flat rate under § 40b EStG as in force on December 31, 2004 (§ 52 Abs. 4 Satz 23 EStG).
- For social security, the tax-free contributions are only exempt up to 4 percent of the pension insurance contribution ceiling, including amounts from salary conversion (§ 1 Abs. 1 Satz 1 Nr. 9 SvEV).
- The employer deducts the subsidy from the wage tax to be paid. If it exceeds the wage tax, the tax office refunds the rest on application (§ 100 Abs. 1 EStG).
- The subsidy only applies to an employer contribution paid in addition to the wages already owed, to a pension fund, Pensionskasse or direct insurance, for employees in their first employment below the income limit, and with evenly spread distribution costs (§ 100 Abs. 3 EStG).
- The circumstances at the time of the contribution are decisive. Later changes do not matter (§ 100 Abs. 4 Satz 1 EStG).
- If the employer already paid an additional contribution in 2016, the subsidy only applies to the amount paid on top of it (§ 100 Abs. 2 Satz 2 EStG).
- With salary conversion, the employer must pass on an additional 15 percent of the converted pay to the pension fund, Pensionskasse or direct insurance, to the extent it saves social security contributions (§ 1a Abs. 1a BetrAVG). For agreements made before 2019, this applies from 2022 (§ 26a BetrAVG).
- Collective agreements may deviate from the mandatory subsidy (§ 19 Abs. 1 BetrAVG).

How much can go into a company pension tax-free?
8 percent of the pension insurance contribution ceiling a year (§ 3 Nr. 63 Satz 1 EStG), of which only 4 percent is free of social security contributions (§ 1 Abs. 1 Satz 1 Nr. 9 SvEV). The euro amounts for the year are under berechnet in the response.
What is the company pension subsidy (BAV-Förderbetrag)?
If the employer pays a low earner at least €240 a year extra into a company pension, it may deduct 30 percent of it from wage tax, at most €288 until 2026 and at most €360 from 2027 (§ 100 EStG).
Does the employer have to add to salary conversion?
Yes, 15 percent of the converted amount, to the extent it saves social security contributions (§ 1a Abs. 1a, § 26a BetrAVG).
